- To determine if you are over-indebted, as defined by the National Credit Act (NCA).
- To negotiate with your creditors on your behalf to reduce monthly payments.
- To apply for and obtain a debt review court order or consent order.
- To process a clearance certificate (Form 19) upon successful completion of the debt review.
- For mandatory reporting to credit bureaus and the National Credit Regulator (NCR).
3. Information Sharing
We treat your information with the strictest confidence. We will only share your personal and financial information with the following parties, as required by law and the debt review process:
- **The National Credit Regulator (NCR):** As a registered debt counsellor, we are legally required to report certain details.
- **Your Creditors:** To facilitate the negotiation and restructuring of your debts.
- **Payment Distribution Agencies (PDAs):** To manage the consolidated monthly payment plan.
- **Credit Bureaus:** To register your application for Debt Review and to issue the Clearance Certificate upon successful completion of the process.
- **Courts/Legal Counsel:** For obtaining the necessary court orders to make your debt repayment plan legally binding.
4. Security Measures
We implement appropriate technical and organisational measures to ensure the security of your personal information, protecting it against loss, destruction, unauthorised access, and unlawful disclosure. Access to your financial records is strictly limited to necessary personnel.
